Recently, the CNIPA released the The White Paper on China’s Intellectual Property Protection in 2020 and the 2020 Annual Report of CNIPA are released, which summarized the overall situation of intellectual property protection in China.
In 2020, the number of invention patent applications in China was 1.497 million, a year-on-year increase of 6.9%. Among them, domestic invention patent applications were 1.345 million, accounting for 89.8% of the total, a year-on-year increase of 8.1%; foreign invention patent applications in China were 152,000, accounting for 10.2% of the total, a year-on-year decrease of 3.0%.
In 2020, the number of utility model patent applications in China was 2.927 million, an increase of 29.0% year-on-year; and the number of design patent applications in China was 770,000, an increase of 8.3% year-on-year.
In 2020, 530,000 invention patents were granted in China, a year-on-year increase of 17.1%. The number of utility model patents was 2.377 million, a year-on-year increase of 50.2%. The number of design patents was 732,230, a year-on-year increase of 31.5%. The patent examination period remained stable, and the high-value patent examination period was cut to 14 months.
In 2020, more than 4.52 million applications for the three types of patents were examined, a year-on-year increase of 20%. Among them, 1.12 million were closed for invention patents, 2.63 million were closed for utility model patents, 2.63 million were closed for utility model patents, and 770,000 were closed for design patents. Three types of patent priority examination cases were accepted and 63,000 cases were accepted, of which 56,000 were invention patent applications. The number of priority examination cases for invention patent applications increased by 61.8% year-on-year.
As of the end of 2020, a total of 325,311 requests for reexamination of patents have been accepted, and 266,263 cases have been closed, with an average closing period of 14.1 months; a total of 67,473 requests for invalidation have been accepted, and 62,541 cases have been closed, with an average closing period of 5.9 months.
In 2020, the number of trademark applications in China was 9.348 million, a year-on-year increase of 19.3%, setting a record high. Among them, the number of online trademark applications was about 9.165 million, accounting for 98.05%, an increase of nearly 17% over 2016. In the whole year, there were 9.116 million domestic trademark applications, accounting for 97.5%, an increase of 20.2% year-on-year. There were 231,000 foreign applications in China, accounting for 2.5%, down 9.4% from the previous year.
In 2020, the number of trademark registrations in China was 5.761 million, a year-on-year decrease of 10.1%. As of the end of 2020, the cumulative number of trademark registrations reached 34.475 million. The average examination period for trademark registration was cut down to 4 months. In the trademark registration review process, 15,600 malicious trademark registration applications that were not intended for use were rejected.
In 2020, a total of 7,553 Madrid trademark international registration applications submitted by domestic applicants were accepted, a year-on-year increase of 16.4%. By the end of 2020, the total number of valid registrations reached 44,223.
In 2020, a total of 134,326 trademark opposition applications were accepted, a year-on-year decrease of 6.54%; and the number of opposition reviews was 149,000, a year-on-year increase of 64.66%. The acceptance rate of trademark opposition was 38.0%, and the partial acceptance rate was 9.2%.
Law enforcement protection
In 2020, public security organs across the country have detected more than 21,000 criminal cases of infringement of intellectual property rights and the production and sale of counterfeit goods, and arrested more than 32,000 suspects, with a total value of more than RMB 18 billion.
In 2020, China’s procuratorial organs nationwide approved the arrest of 7174 people in 3,930 crimes, and sued 12,152 people in 5,848 cases.
