Release of the 2023 Outline for Building a Strong Intellectual Property Rights System and the Implementation and Promotion Plan of the 14th Five Year Plan

In order to further implement the strategy of building a strong IPR system and clarify the key tasks and work measures in 2023, CNIPA has issued the 2023 Outline of Building a Strong Intellectual Property Rights System and the Implementation Promotion Plan of the 14th Five Year Plan (referred to as the Promotion Plan). The Promotion Plan specified 139 key tasks and work measures in seven major areas.


In terms of improving the intellectual property system, the Promotion Plan requires the improvement of intellectual property laws and regulations, the reform and improvement of major intellectual property policies, and the improvement of intellectual property rules in emerging and specific fields. Specifically, measures are proposed to promote the revision of relevant laws and regulations, implement the construction of a first-class patent and trademark examination institution, and accelerate the construction of IPR data protection rules.


In terms of strengthening intellectual property protection, it is required to strengthen judicial protection of intellectual property, administrative protection of intellectual property, and improve the collaborative protection pattern of intellectual property. Specifically, measures are proposed to deepen the reform of the appeal and trial mechanism for intellectual property cases at the national level, strengthen professional guidance for trademark and patent law enforcement, and establish national intellectual property protection demonstration zones with high standards.


In terms of improving the operational mechanism of the intellectual property market, it is required to improve the quality of intellectual property creation, strengthen the comprehensive application of intellectual property, and promote the market-oriented operation of intellectual property. Specifically, measures such as reforming and improving the intellectual property assessment and evaluation mechanism, vigorously cultivating and developing patent intensive industries, and deepening the implementation of patent conversion special plans are proposed.


In terms of improving the level of intellectual property public services, it is required to strengthen the supply of public services and improve their efficiency. Specifically, it is proposed to promote the open sharing of more intellectual property data and continuously strengthen the hierarchical classification management of intellectual property public service institutions.


In addition, the Promotion Plan also specifies specific measures for creating a good cultural and social environment for intellectual property, deeply participating in global intellectual property governance, and strengthening organizational protection.
